By accessing or using Blitz ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including developers, visitors, and account holders.

Blitz is operated by Blitz, Inc., a company based in San Francisco, California. We reserve the right to update these Terms at any time. Your continued use of the Service constitutes acceptance of any modifications.

Description of Service

Blitz provides BlitzOS, a native macOS application that brings the AI agents you already use, such as Claude and Codex, into one place and connects them to your apps so they can get work done across them. Our Service includes the BlitzOS desktop application and related tools.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload or distribute viruses, malware, or malicious code

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including removing content, suspending or terminating accounts, and reporting to law enforcement.

Intellectual Property

Your Content

You retain ownership of any code, applications, and content you create using the Service. By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, and process your content solely to provide and improve the Service.

Our Content

The Service, including its design, features, code, and documentation, is owned by Blitz and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

Subscription and Payment

Certain features of the Service may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees according to the pricing plan you select
• Provide valid payment information and keep it current
• Automatic renewal of your subscription unless you cancel before the renewal date

Subscription fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with advance notice to existing subscribers.

Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if:

• You violate these Terms
• Your account has been inactive for an extended period
• We determine that continued use poses a security or legal risk
• Required by law or legal process

Upon termination, your right to use the Service immediately ceases. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. You use the Service at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLITZAPPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Blitz, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Third-Party Services

The Service may integrate with or link to third-party services and websites. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and conditions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be governed by the laws of the State of California, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts located in San Francisco County, California.

For any disputes, you agree to first contact us to attempt informal resolution before pursuing legal action.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blitz regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
